Do I have a claim?
Every claim is different, but if the accident is not your fault it is likely you have a good claim. To get advice about your claim, complete our enquiry form. Then one of our experienced personal injury staff can quickly assess and advise you about the chances of success of your claim.
Is it worth claiming?
A successful personal injury claim will provide you with a lump sum of money, to help you to get your life back on track. While money can hardly compensate for broken bones, the money might be needed to pay for special nursing needs and to make up for any loss of earnings - yours and/or that of your family.
By reporting the accident and making a claim for compensation, you are helping to prevent future accidents. This is because safer practices and working conditions often only come about because of the investigations instigated by a claim. In serious accidents, the Health and Safety Executive will be involved.
There is very little work on your part, once you have instructed a competent solicitor to act for you. You could leave it all to the experts and just focus on recovering from your injuries and getting on with your life.
What will my claim cost?
Almost all claim are covered by a conditional fee Agreement, which is commonly known as a no win, no fee agreement. This will cost you nothing and will be explained to you in detail by your solicitor at the outset of your claim. Your solicitor will pay us a modest fee for the referral which will not be passed onto you.
What are the risks involved for me?

What is 'no win - no fee'?
A term used to indicate that there is no fee to pay whether you lose or win your claim and this arrangement is made by written a agreement between your lawyer and yourself and drawn up in accordance with Law Society rules. It is known as a Conditional Fee agreement and although it protects you in respect of your own legal costs you will be required to take out insurance to cover the costs you will have to pay to your opponent if you lose.
Will I have to sign up for a loan or insurance policy?
There are no hidden charges and you will not be asked to sign up for a loan or insurance policy.
Will someone call at my house or will I have to attend a solicitor's office?
If you require a home visit this can be arranged although it will not be necessary and your claim can be dealt with through correspondence and over the phone.
How much compensation can I claim?
Every case is different and the value of any claim will depend on the circumstances and the extent of your injuries - both physical and psychological. MyClaim will be able to advise you of the level of compensation you are likely to receive for your particular case.
Personal injury compensation claims will normally be split into two parts.
General Damages: To compensate for the pain and suffering of your injury, both the initial injury and any ongoing suffering or disability; loss of amenity or enjoyment of life; and for any disadvantage in the labour market caused by permanent injury. The figure awarded can vary dependent on factors such as the severity of your injuries, your gender and age. It is not an exact science, hence the term 'general', and will either be agreed by negotiation or awarded by a judge.
Special Damages: to compensate for all other losses, where an exact figure is known and can be supported by documentation to prove the loss. These losses may include:
- Loss of past and future earnings
- Damage to property and possessions
- Vehicle damage
- Prescriptions, medical fees and therapy
- Care and assistance for household chores
- Special care aids and equipment
- Adapted accommodation and transport
- Travelling expenses
- Out of pocket expenses
How long should my claim take?
The length of time a claim will take to settle and result in you obtaining compensation will depend on the nature of your accident. A straightforward road traffic accident can be settled within a matter of months, depending on the severity of your injuries. Whereas a complex accident at work where the injuries suffered are serious often take longer. Once we have carried out an initial investigation, we will be in a better position to anticipate how long it will take. You can be assured that the Accident Injury Line will not delay the progress of your claim.
Will I have to go to Court?
We understand that you might be wary of going to Court. However, the vast majority of personal injury claims for compensation never go to trial - most claims are settled following negotiations with the insurance companies.
What if my injury occurred a while ago?
If you are over 18 and your accident happened in England or Wales you have 3 years in which to bring a claim for personal injury. If you are under 18, the three year period starts from your 18th birthday.
Do I need to have reported my injuries to my GP or hospital?
It can be beneficial to have a written record of the injuries either at your GP or hospital but this is not essential. If you have not been to visit your GP or hospital it should not prevent you from making a claim.
Do I need to meet my solicitor?
This is up to you - most people are happy to keep in touch by telephone, email and letters but some people prefer to meet their solicitor face to face. If required, your MyClaim solicitor will visit you in hospital or at home.
